Here are the terms:

Welcome to Her Tactical. This website located at HerTactical.com (this “Site”) is owned and operated by E & R, LLC (the “Company”, “E & R” AKA HER TACTICAL).

• HER TACTICAL is owned and operated by E & R LLC. Payments will be from E & R LLC (AKA HER TACTICAL)
• Once approved for our affiliate program you can create a dedicated referral link on your affiliate account page. You can customize this link to best suit you.
• You will be paid a commission of 10% on all HER TACTICAL branded products, when a visitor uses your affiliate link to purchase products, and no returns or refunds are made within the 30 day return grace period.
• When you see the word ‘Affiliate’ in the tag section of a product page this indicates a product you will earn a commission on
• Cookies are active for 60 days. This means when someone you refer to our website using your affiliate link you will earn a commission, if they purchase anytime within the 60 days of using the active affiliate link.
• Commission payments are made to your PayPal account. We will need your PayPal email address to complete payment.
• Payments are generated after your account reaches $50 and after 45 days of the sales date to ensure no returns are made. Payments to affiliates are generated bi-monthly (every 2 months).
• Affiliates are responsible for any and all charges, fees, taxes, exchange rates, surcharges and other expenses incurred in order to receive affiliate payments. Please check with your receiving banking institution to find out if any of these apply for your account.
• Affiliates can keep track of their earning on their affiliate account page
• You will not be able to make commission on your own purchases
• You can request a 10% coupon code be generated for your audience. We can customize the coupon code name to whatever you like. You can use this code for your own personal purchases. Coupon codes can not be used in conjunction with any other offer or for wholesale orders.
• The benefits of the affiliate program is not to be used in conjunction with any other program
• You will be open and honest about Your relationship to Us: You may not misrepresent or embellish the relationship between you and HER TACTICAL or imply any relationship or affiliation between you and HER TACTICAL or any other person or entity except as expressly permitted by this affiliate Agreement. You may not represent yourself as an agent or employee of HER TACTICAL or represent that you have the authority to bind HER TACTICAL to a contract.
• We reserve the right to cancel your affiliate membership for abuse of the program or for any reason we deem
• Not all applicants are granted approval into the affiliate program
• You are expected to hold HER TACTICAL in the best light when promoting our company and products. We both agree not to use the other’s proprietary materials in any manner that is disparaging or that otherwise portrays the other in a negative light. 
• You must declare that you are an affiliate of our program any time you are promoting our company or products
• Our digital assets are the sole right and property of HER TACTICAL. You are given permission to use these assets to promote our company and products under this affiliate program only. Abuse of these assets may result in your affiliate membership being canceled and payments ceased immediately. Do not alter the images in any way. You will not mimic Our media and content: Publishers must make sure that his or her media does not copy or resemble the look and feel of the HER TACTICAL website or create the impression that Your media is part of Our company’s website. You also understand that using the language found on Our pages verbatim is not allowed unless it is to describe the content found on any given product page. If you would like an image or video that is not available in the asset library please make a special request by email for approval.
• HER TACTICAL and HER NATION are registered trademarks, and they are not to be used in any variation in your domain names or social media pages. You may not register or purchase domain names that include Our company’s name or any misspellings or variations of Our company name to run promotions as an affiliate. Additionally, you may not include Our Company name, variations of Our company name, or the look and feel of Our own social media pages on any social media pages (i.e. Facebook Fan Page) where You run promotions as an affiliate.
• Disclaimer: WE MAKE NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING HER TACTICAL. ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY AND NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED AND EXCLUDED. IN ADDITION, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS.

FURTHER, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THESE AFFILIATE TERMS, IN NO EVENT SHALL OUR CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THESE AFFILIATE TERMS, WHETHER BASED IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT, OR OTHER LEGAL OR EQUITABLE THEORY, EXCEED THE TOTAL REFERRAL FEES PAID TO YOU UNDER THESE AFFILIATE TERMS.
• Indemnification: You agree to indemnify and hold harmless HER TACTICAL and its employees, representatives, agents, and affiliates, against any and all claims, suits, actions, or other proceedings brought against them based on or arising from any claim resulting from Your breach of these Affiliate Terms. You will pay any and all costs, damages, and expenses, including, but not limited to, reasonable attorneys’ fees and costs awarded against or otherwise incurred by Us in connection with or arising from any such claim, suit, action, or proceeding.
• Termination: HER TACTICAL or You can Each End Our Engagement Under these Affiliate Terms: Either Us or You may end these Affiliate Terms AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of email to hertactical@gmail.com
• Modification: From time to time, We may update these Terms to clarify Our practices or to reflect new or different practices, for example We may change the scope of Referral Fees, payment procedures, and Affiliate Program rules, or Referral Specifications or Referral Materials, and HER TACTICAL reserves the right in its sole discretion to modify and/or make changes to these Affiliate Terms at any time, at Our sole discretion. If We make any material change to these Affiliate Terms, You will automatically receive an email notifying You that changes were made and prompting You to agree to Our new Affiliate Terms. Modifications will become effective on the day they are posted unless stated otherwise.  Your continued access to Our affiliate program will be contingent on Your acceptance of Our updated Affiliate Terms. You should visit the Services regularly to ensure You are aware of any changes to the Affiliate Terms, as any revised Affiliate Terms shall supersede all previous Affiliate Terms.

By accepting delivery of your HER TACTICAL order, you acknowledge and agree to the following terms:

Firearms are dangerous instruments and should be handled only by responsible persons who have completed a certified training course in the safe handling and use of firearms. YOU, THE CONSUMER, ASSUME ANY AND ALL RISK ASSOCIATED WITH THE PURCHASE AND USE OF HER TACTICAL PRODUCTS. BECAUSE HER TACTIAL HAS NO CONTROL OVER HOW ITS PRODUCTS WILL BE USED OR WHO SUCH PRODUCTS WILL BE USED BY AFTER PURCHASE. HER TACTICAL DISCLAIMS ANY AND ALL LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES TO PERSON(S) AND/OR PROPERTY RESULTING FROM THE USE OF ANY HER TACTICAL PRODUCTS. YOU, THE CONSUMER, ASSUME ALL RISK OF PERSONAL INJURY OR DEATH CLAIMS AS A RESULT OF YOUR USE OF HER TACTICAL PRODUCTS.

You, on behalf of yourself and your personal representative, spouse, heirs, successors and assigns and each of them, agree to hold harmless, release, indemnify, and discharge from any and all liability HER TACTICAL and its affiliates, members, managers, assigns, officers, directors and employees, and each of them, from any and all claims, demands, obligations, losses, causes of action (whether in law or equity) cost, expenses, attorney fees and liabilities of any nature whatsoever, whether based in contract, tort, statute or legal or equitable theory of recover, whether known or unknown, asserted or unasserted, which you now have or which may arise out of or related to your use of any HER TACTICAL products.

It is your responsibility as the consumer to personally check for holster and handgun compatibility. Never place a loaded handgun in a holster without first testing holster and handgun compatibility and fit using your handgun in an unloaded condition (double check to make sure the chamber is empty). For information on how to safely carry your particular handgun, please refer to your handgun manufacturer’s safety and instruction manual.

Make certain that your handgun is securely seated in the holster each time you secure your handgun before removing your hand from the grip. A handgun must securely fit in the holster to guard against accidental separation of the handgun from the holster. Never place your hand in front of the firearm barrel while trying to store or remove your firearm from the holster. Keep your finger off the trigger until you are ready to appropriately discharge your handgun. Keep your fingers off the trigger and out of the trigger guard when drawing or replacing the handgun in the holster.

Should your holster become worn, loose, defective, or ill-fitting at any time, immediately cease use of your handgun with the holster.
