Waiver, release of liability and videography release form

CONSENT TO ASSUME RISKS, AWARENESS OF INHERENT RISKS, EXPRESS ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY

In consideration for and as an express condition for permission to enter and participate in any workshop or activity facilitated by E & R LLC – DBA HER TACTICAL located at the Weber County Sports Shooting Complex 2446 Rulon White Blvd Ogden UT 84404 or any other location throughout Utah that E & R LLC facilitates self-defense and firearms training, the undersigned enters into an agreement with E & R LLC, a Utah Limited Liability Company, doing business as “HER TACTICAL” (hereinafter “HER TACTICAL”) and agrees to the following: 

By participating in this workshop I wish to be trained in self-defense and firearm safety and the permissible use of firearms taught by G. C. Training and facilitated by HER TACTICAL. In making this request for training, I understand and agree to the following:

1. The use of a firearm even solely for training purposes is a dangerous activity and one which presents a risk of serious bodily harm to myself, and others.

2. In undertaking this self-defense and firearms training I am solely and completely responsible for any physical injury or damage, death, or property damage arising out of or which is a consequence of my participation and/or manner of participation and I hereby voluntarily assume the risks of all such injury and damage and hold HER TACTICAL, their employees, volunteers, agents and designee/s completely harmless therefrom.

The undersigned agrees to indemnify and hold harmless HER TACTICAL and each of their agents, officers, volunteers and employees from any and all claims, demands, actions, liability or loss which may arise from or be incurred as the result of injury or damages to persons or property, including the person and property of the undersigned, arising out of the undersigned’s use and participation in the self-defense and firearms training, and of the firearm shooting range located at Weber County Sports Shooting Complex or any other facility where the training is being held.

I (the undersigned) hereby grant to HER TACTICAL the right to photograph me and to record my voice, performances, poses, actions, plays and appearances, and use my picture, photograph, silhouette and other reproductions of my physical likeness in connection with the Self-defense and Firearms Workshop for Women.

I hereby grant to the HER TACTICAL, the videographer and their successors, assigns and licensees the perpetual right to use, as the Videographer may desire, all still and motion pictures and sound-track recordings and records which the Videographer may make of me or of my voice, and the right to use my name or likeness in or in connection with the exhibition, advertising, exploiting and/or publicizing of the video. I further grant the right to reproduce in any manner whatsoever any recordings including all instrumental, musical, or other sound effects produced by HER TACTICAL, in connection with the production and/or postproduction of the Video.

I agree that I will not assert or maintain against the Videographer or their successors, assigns and licensees, any claim, action, suit or demand of any kind or nature whatsoever, including but not limited to those grounded upon invasion of privacy, rights of publicity or other civil rights, or for any reason in connection with the Videographer’s authorized use of my physical likeness and sound in the Video as herein provided.

I hereby declare under the penalty of perjury under the laws of the State of Utah that I have read, understood and agree to the foregoing terms and conditions. Executed at Weber County Utah.
